A Federal High Court in Lagos has ordered MTN Nigeria to pay N840 million for trademark infringement. The court ruled that MTN unlawfully used the "WEBPLUS" trademark, which is owned by Citilink Accesscorp Limited and registered under Class 9 of the Trademark Registry.
Justice Akintayo Aluko found that MTN's use of "MTN WEBPLUS" or "MTN WEB+" mimicked Citilink's trademark, causing loss of business and brand dilution. The judge awarded N70 million in yearly damages from 2014 to 2025 and ordered MTN to pay 15% annual interest on the judgment sum until it's fully paid.
Citilink had accused MTN of infringing on its trademark, which was registered in 2001 and renewed in 2014. The company argued that MTN's use of similar variants was unauthorized, misleading, and damaging to its brand.
The court also granted a perpetual injunction against MTN, barring the telecom giant from further use of the disputed trademark. However, the court denied some of Citilink's additional demands, including the request for the seizure and destruction of MTN's servers and a claim for N10 million in special damages due to insufficient proof.
